Bennett, Coleman & Co. Ltd. (“BCCL”) is a company within the meaning of the Companies Act, 2013, having its Registered Office at The Times of India Building, Dr. D. N. Road, Mumbai 400001 and its Corporate Office at 9-10, Express Building, Bahadur Shah Zafar Marg, New Delhi – 110 002.

By participating in the “I am Kolkata-Green Kolkata” campaign (“Initiative”), you accept and agree that you are a resident welfare association (“RWA”) duly registered under the applicable laws within the State of West Bengal, represented by the authorized office bearer/member of the management committee of the Resident Welfare Association and accept, agree and remain abide to the following terms and conditions:-

1. INITIATIVE

(A) The Initiative shall be known as ‘I am Kolkata-Green Kolkata’ and shall be held only between 9 September 2024 to 31 October 2024 (hereinafter known as “Period of the Initiative”). (B) The Initiative is organized, managed and conducted by BCCL. (C) This Initiative is subject to BCCL’s policies and other conditions. (D) There shall be no entry fee for the Initiative and the Initiative is being organized as a consumer engagement initiative. (E) The participant should follow all the participation steps and answer the questions based on facts by applying their minds while participating in the Initiative.

2. GUIDELINES FOR PARTICIPATION
   • Eligibility: Open to all Resident Welfare Associations duly registered under the applicable laws within the State of West Bengal.
   • Individual Participation:Each participant may submit only one entry.
   • Participation Process:The Participant shall visit the official website of the Initiative – Entries must be true and accurate.
   • Submission Deadline:The Initiative runs during the Period of the Initiative. No entry will be accepted after 31 October 2024.
   • Winner Selection:A group designated by BCCL (which may or may not consist of any third-party) will visit the participating RWA for an on-site review to evaluate the entry submitted by the participant. The review visits will be scheduled at the discretion of BCCL. Participant will be informed in advance about the visit date and time on the mobile number/email ID provided during the registration process. The participant agrees that the review team has the right to capture images/videos of the site. The participant must ensure that its representatives are available on the scheduled review date to provide necessary access and information to the review team without any delays or obstructions. Failure to comply with these conditions will result in disqualification of the participant.
     
     Upon successful completion of the review process, the entries will be evaluated by the jury appointed by BCCL (which may or may not consist of any third-party) based on the review report and the participant’s entry. The decision of the judges will be final and binding.
   • Feature:
     As a prize, the winning entries will feature in The Times of India print and digital publication and certificate will be given to them. Mere submission of the entry does not give any warranty or guarantee of publication in BCCL feature or the certificate
3. OTHER TERMS
   • BCCL shall have right to disqualify any entry on the basis of failure to abide by these terms and conditions, bad faith or any other legitimate reason. BCCL may also ask any participant to provide proof of identification and other details.
   • In case of any third-party dispute due to submission of entry by any participant, the participant/its authorized office bearer/members of the management committee shall indemnify BCCL, its affiliates, its directors, its employees and any third-party vendor against any such third-party claim(s).
   • BCCL is not responsible for any incorrect or inaccurate information, whether caused by website users or by any equipment or programming associated with or utilized in the Initiative. BCCL is not responsible for any problems or technical malfunction of any network or lines, computer online systems, servers, providers, computer equipment, software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this Initiative.
   • By entering into the Initiative, the participants agree to grant exclusive, worldwide, perpetual and irrevocable right to BCCL and its affiliates, contractors, service providers, clients, agents and partners to portray them as winners of the Initiative, and to exhibit this material along with the entries and/or the images/videos captured at the on-site visit, in any manner BCCL may deem fit, in its own discretion, in any and all media now existing or hereinafter created, including, without limitation, television, film, radio, print and digital media, without payment of any consideration whatsoever, including, without limitation, for advertising and publicity purposes.
   • The participant voluntarily agrees to submit the required documents and personal information (including, without limitation, their representative’s name, address, mobile number, email ID, etc.) to participate in the Initiative. The participant voluntarily consents and permits BCCL to use any personal information that the participant provides in accordance with applicable laws for the purposes of this Initiative and for any marketing or other purposes. BCCL may also share such information(s) with its affiliates, contractors, service providers, clients, agents and partners for the purpose of this Initiative. The information may also be used by BCCL for: (i) recommending various products or services, including those of third parties; (ii) dealing with requests, enquiries and complaints and Initiative related activities; (iii) marketing products and services and its analysis; (iv) abiding with laws and law enforcement/regulatory requests.
   • The decision of BCCL management is final and no correspondence or any other claims whatsoever in this regard will be entertained.
   • BCCL reserves the right to change, alter or cancel this Initiative in part or full, or change any or all of the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages.
   • Nothing contained herein amounts to a commitment or representation by BCCL to conduct further or other Initiatives. BCCL expressly disclaims all warranties of any kind, whether express or implied. In no event shall BCCL be liable under these terms for any loss to the participant for any error or omission or any consequential, special, indirect, exemplary, punitive, or any loss of profit, goodwill or opportunity or other damages, including, arising out of any failure or alleged failure to perform any of its obligations under these terms whether based in contract, tort (including negligence) or otherwise.
   • In no event shall the aggregate liability of BCCL exceed INR 500/-.
   • This Initiative shall be governed by and construed in accordance with the laws of India. All disputes shall be subject to the jurisdiction of the Courts at Kolkata, India only.
   • Participants’ entering the Initiative shall be deemed as his/her acceptance of the terms and conditions. Participant shall not conceal or misrepresent any information during the scrutiny or otherwise, failing which the participant shall be disqualified for participating in the Initiative.
   • In accordance with the applicable laws, for any grievance, you may reach the grievance officer of BCCL at timesofabetterindia@timesgroup.com. The Privacy Policy located at https://timesofindia.indiatimes.com/privacy-policy/cookiepolicy/86934312.cms shall form an integral part of these terms. Interpretation of terms & conditions for any legal issue will be considered only in English.
